Key facts

  • The basic semaglutide compound patent family (WO2006097537, Novo Nordisk) was filed on 20 March 2006, so national patents without an extension ended on 20 March 2026.
  • India: compound patent expired in March 2026 and generic semaglutide medicines went on sale from 21 March 2026, after the Delhi High Court refused Novo Nordisk interim relief.
  • China: the compound patent also ended in March 2026, but Novo Nordisk says regulatory data protection runs to the second quarter of 2027.
  • Canada: the patent lapsed in 2019 for an unpaid maintenance fee and data protection ended on 4 January 2026; Health Canada approved the first generics in spring 2026.
  • United States: the Orange Book lists US 8,129,343 to 5 December 2031 (Novo Nordisk reports 2032). Europe and Japan: 2031, with extensions.

Semaglutide’s basic compound patent ended in most of the world on 20 March 2026. In the United States, Europe and Japan it is extended into 2031 or 2032. Canada has had no compound patent since 2019. The date that matters to an API buyer is not one date but a set of them, and the compound patent is only one of the barriers to a generic launch.

This article sets out the dates market by market, the basis for each, and what they mean for companies sourcing semaglutide API. Every date is linked to its source; where we could not confirm a date from a primary record, we say so. This is a summary for procurement and regulatory teams, not legal advice.

Why March 2026: the basic patent family

The semaglutide molecule is protected by Novo Nordisk’s patent family WO2006097537, “Acylated GLP-1 compounds”. It claims priority from 18 March 2005 and was filed as an international (PCT) application on 20 March 2006. National members include US 8,129,343, EP1863839, CA 2,601,784, CN101133082B, JP5209463B2 and BRPI0607762 (Google Patents).

A patent’s 20-year term runs from the filing date, not the priority date. Wherever no extension applies, the semaglutide compound patent therefore ended on 20 March 2026. Extensions explain the later dates in the US, Europe and Japan, which compensate for time lost in regulatory review.

Country by country

India

The Indian compound patent ended in March 2026. Before expiry, Novo Nordisk sought to restrain an Indian generic manufacturer from making and exporting semaglutide. On 9 March 2026 the Delhi High Court division bench dismissed Novo Nordisk’s appeal against the refusal of an interim injunction (FAO(OS)(COMM) 204/2025), as reported by IAM. Several Indian manufacturers launched generic semaglutide medicines as soon as the patent expired, with launches reported from 21 March 2026 (The South First).

For API buyers, India is now an open market for semaglutide manufacture, and Indian API makers can also supply markets where compound protection has ended.

China

The Chinese compound patent survived invalidity challenges: Novo Nordisk reports that it was upheld by the Beijing IP Court in November 2023 and by the Supreme People’s Court in December 2025 (Form 20-F). It expired in March 2026 under the 20-year rule, and Novo Nordisk’s annual report lists China as 2026.

Patent expiry has not opened the market yet. In June 2026, Novo Nordisk’s chief executive was reported as saying that regulatory data protection for semaglutide in China lasts until the second quarter of 2027, after which generics can enter (Huxiu, Chinese-language). Domestic applicants’ reviews are reported to be waiting on that date.

Canada

Canada is the exception among high-income markets. The Canadian compound patent, CA 2,601,784, lapsed after the 2019 maintenance fee was not paid, and the period for reinstating it has passed. Data exclusivity ended on 4 January 2026 (Mondaq). Health Canada approved the first generic semaglutide products in late April and early May 2026, with further submissions under review (Drug Discovery & Development).

Brazil

The Brazilian family member, BRPI0607762, follows the same 20-year term from the March 2006 filing date (Google Patents), so compound protection ended in March 2026. Market entry depends on ANVISA approval of each generic application.

United States

FDA’s Orange Book data files list US patent 8,129,343 against semaglutide applications, covering drug substance and drug product, with an expiry of 5 December 2031. That is exactly 14 years after the first US approval of a semaglutide product on 5 December 2017, which is the maximum effective term allowed after a patent term extension under 35 U.S.C. 156. Novo Nordisk reports US compound patent expiry as 2032 in both its annual report and its Form 20-F; the difference is not explained in either document.

Novo Nordisk has settled patent litigation with several companies that filed abbreviated new drug applications. Its Form 20-F states that the terms are confidential, so there is no public date for earlier generic entry.

European Union and United Kingdom

In the EU, supplementary protection certificates under Regulation (EC) No 469/2009 extend protection for up to five years beyond the basic patent. Novo Nordisk reports European compound protection as 2031, based on Germany. Combining the 20 March 2026 patent expiry with the five-year SPC maximum gives 20 March 2031, but SPC dates are granted country by country, so check the national register for each market you plan to supply.

For the UK, we could not confirm the SPC expiry from the UK Intellectual Property Office register when writing this article. It is likely to mirror the European date, but treat that as unconfirmed.

Japan

Novo Nordisk reports Japanese compound protection, including extension, as 2031.

Compound patent expiry is not freedom to operate

The compound patent is the broadest barrier, but not the only one. Before a generic semaglutide product launches in any market, the applicant still has to clear:

  • Other patents. Formulation, process, dosing-regimen and device patents can outlast the compound patent.
  • Regulatory data protection. China shows how data protection can hold back generics after the patent has gone.
  • Litigation and settlements. The US settlements are confidential, and market-specific injunctions are possible.
  • Development exemptions. In the EU, the Bolar provision in Article 10(6) of Directive 2001/83/EC covers studies and trials needed for a generic application; in the US, 35 U.S.C. 271(e)(1) protects work done to generate data for FDA. National interpretations differ, particularly on third-party API supply, so take advice for each market.

What patent expiry means for API buyers

Timing differs by up to six years

Buyers serving India, Canada and Brazil can source commercial semaglutide API now. China follows from about mid-2027. The US, EU, UK and Japan stay closed to commercial generic supply until 2031–2032, but development and regulatory batches can be sourced earlier within the exemptions above. Most generic programmes for those markets are being built now, which is why API qualification work is happening years before launch.

Sealed glass vials, a common format for peptide samples. For markets still under protection, development and regulatory batches can be sourced ahead of launch within the applicable research exemptions.

The supplier field is already crowded

FDA’s list of Drug Master Files currently shows 95 active Type II DMFs whose subject names semaglutide, covering the drug substance, process variants and intermediates. A listed DMF is not an FDA endorsement, but it shows how many API sources are preparing for the US market. In Europe, a search of the EDQM certification database for semaglutide returned no record on 11 October 2026, so EU filings will rely on the ASMF procedure or full dossier data. See our buyer guides for Europe and the USA.

Regulators are tightening the analytical bar

The semaglutide reference product’s peptide backbone is made by yeast fermentation, while many generic APIs are synthetic. Both FDA and EMA have reworked their expectations in 2026:

  • On 28 July 2026 FDA withdrew its 2021 guidance on synthetic peptide ANDAs and published revised draft product-specific guidances, including one for semaglutide injection, with impurity reporting above 0.1% and identification above 0.5% (FDA).
  • EMA’s synthetic peptides guideline has applied since 1 June 2026 and expects a full impurity comparison against the EU reference product at 0.1–0.5%.

An API supplier’s impurity profile and analytical package therefore matter as much as price. Our guides on peptide API impurities and specifications and how to qualify a peptide API supplier cover what to ask for.

FDA and EMA now expect impurity data down to the 0.1% level, so analytical capability is part of choosing a semaglutide API supplier.

Separately, semaglutide and the rest of our peptide range are supplied for research use only, not for human or veterinary use.

For programmes that need lyophilised vials for research and development, our peptide lyophilisation CMO service works from client-supplied API. To discuss a requirement, see the Winhycare Pharma overview or send a project enquiry.

Frequently asked questions

When does the semaglutide patent expire in the US?+

FDA's Orange Book lists US patent 8,129,343, which covers semaglutide drug substance and drug product, as expiring on 5 December 2031. Novo Nordisk reports US compound patent expiry as 2032. Novo Nordisk has settled with several generic applicants on confidential terms, so no public early-entry date exists.

When does the semaglutide patent expire in Europe and the UK?+

Novo Nordisk reports European compound protection, based on Germany, as running to 2031 through supplementary protection certificates. That is consistent with a March 2031 SPC expiry. We could not confirm the UK SPC date from a primary register at the time of writing.

Has the semaglutide patent expired in India?+

Yes. The Indian compound patent ended in March 2026, and several Indian manufacturers launched generic semaglutide medicines from 21 March 2026. Before expiry, the Delhi High Court division bench dismissed Novo Nordisk's appeal for an interim injunction on 9 March 2026.

Can generic semaglutide be sold in China after March 2026?+

Not immediately. The compound patent ended in March 2026 and was upheld in validity challenges until then, but Novo Nordisk has said regulatory data protection in China lasts until the second quarter of 2027, which delays generic approvals.

Does compound patent expiry mean a generic can launch?+

Not on its own. Formulation, process and device patents, regulatory data protection and market-specific litigation can all delay launch. Freedom to operate has to be assessed market by market with patent counsel.
